PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY BEFORE ACCESSING OR USING THE JOBHACKERS GLOBAL SERVICE IN ANY WAY. IF YOU DO NOT AGREE TO ALL OF THE TERMS, DO NOT USE THE JHG SERVICE.

Welcome to JobHackers Global (JHG)! JHG makes this website and all content and elements thereof, including but not limited to text, data, information, reviews, ratings, videos, notes, software, designs, graphics, images, sounds, and other files and materials (collectively, Content), all trademarks, service marks, trade names, and logos (collectively, Marks), and all Interactive Features, mobile applications, blogs, social media platforms, digital platforms, tools, and applications provided by JHG (collectively, Features), available for your use subject to these Terms.

These Terms constitute a legally binding agreement between DigitalPathways Ltd., a Singapore-registered company operating under the brand name JobHackers Global (JHG), and you personally and, if applicable, on behalf of any entity for whom you are using the Service (collectively, you). By accessing or using the Service in any way, you confirm that you have read, understood, and agreed to be bound by these Terms.

1. REVISIONS AND UPDATES TO THESE TERMS

JHG reserves the right to update, change, and modify these Terms and its other rules, guidelines, and policies at any time in its sole discretion. All modifications will be effective immediately upon being posted on the Service. Your continued use of the Service after any modifications constitutes your acceptance of the updated Terms. JHG recommends you periodically review the current Terms as they are binding on you. If you do not agree with any updated Terms, you must discontinue use of the Service immediately.

2. THE SERVICE

JHG provides an online career coaching and training platform designed to help job seekers, professionals, and career changers accelerate their career growth, navigate job markets, and develop skills to secure meaningful employment opportunities. As part of the Service, JHG makes available community platforms (e.g., Skool), discussion forums, chat rooms, video coaching sessions, collaborative workspaces (e.g., Slack), group coaching calls, social media platforms, blogs, and other interactive features (collectively, Interactive Features).

JHG's coaches, experts, consultants, and moderators use the Interactive Features to provide guidance, advice, feedback, and other information to users in real-time and otherwise. JHG grants you, subject to these Terms, the revocable right to use the Interactive Features to post, upload, share, submit, or otherwise make available your comments, communications, questions, answers, feedback, suggestions, ideas, photographs, videos, and other user-generated content (collectively, Contributions).

JHG is not responsible for the operation, terms of use, or policies of any third-party platforms, including but not limited to Skool and Slack. You are encouraged to review the terms and privacy policies of any third-party platform before use. You acknowledge that other users may occasionally share content that is inaccurate, misleading, or otherwise offensive. JHG is under no obligation to screen, monitor, edit, or remove such content and does not endorse or bear responsibility for any user communications or content on the Service.

JHG RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO MODIFY, SUSPEND, CANCEL, LIMIT, RESTRICT, INTERRUPT, DISCONTINUE, REMOVE, OR DISABLE ACCESS TO THE SERVICE OR ANY PARTS THEREOF AT ANY TIME, EITHER TEMPORARILY OR PERMANENTLY, FOR ANY REASON, WITHOUT NOTICE. IN NO EVENT WILL JHG BE LIABLE FOR SUCH ACTIONS.

YOU ACKNOWLEDGE THAT YOUR ACCESS TO AND USE OF THE SERVICE, INCLUDING ANY CONTENT OBTAINED THROUGH THE SERVICE, IS AT YOUR OWN DISCRETION AND RISK. JHG PROVIDES NO GUARANTEE THAT THE SERVICE WILL MEET YOUR CAREER GOALS OR OBJECTIVES. RESULTS MAY VARY BASED ON INDIVIDUAL EFFORT, CIRCUMSTANCES, AND MARKET CONDITIONS.

3. USER ACCOUNTS AND REGISTRATION

To access certain Content and Features, or to purchase products or services via the Service, you may be required to create a user account (User Account). You may be asked to adopt a unique user ID (User ID) and password. To complete registration, you must provide accurate information including your name, telephone number, email address, and payment details.

In creating and using your User Account, you agree to: (a) provide true, accurate, current, and complete information; and (b) maintain and promptly update your information so it remains accurate at all times. If you provide any untrue or incomplete information, JHG may suspend or terminate your User Account in its sole discretion.

To use the Service, you must be 18 years of age or older. THE SERVICE IS NOT INTENDED FOR ANYONE UNDER THE AGE OF 18. YOUR USER ACCOUNT MAY BE DELETED WITHOUT WARNING IF JHG BELIEVES YOU ARE UNDER 18 YEARS OF AGE.

User Accounts, User IDs, and passwords are non-transferable. You are solely responsible for all activities that occur through your User Account. Please contact JHG immediately at support@jobhackersglobal.com if you suspect any unauthorized use of your account. While JHG follows generally accepted security standards to protect User Information, JHG cannot guarantee that information transmitted via the internet is fully secure. You provide your personal information at your own risk.

4. FEES AND PAYMENT TERMS

JHG charges users certain fees in connection with certain Content and Features of the Service (Fees). All Fees are stated in Singapore Dollars (SGD) unless otherwise provided. You are responsible for the timely payment of all Fees and for providing JHG with a valid payment method. JHG reserves the right to assess late fees and suspend your access to the Service until payment is received in full.

If JHG is unable to collect fees owed and you fail to make acceptable payment arrangements, JHG may employ collection agencies or attorneys and pursue all remedies available at law or equity. Late or missed payments may be reported to relevant credit reporting agencies.

5. PRIVACY POLICY

All personal information provided to or collected by JHG will be treated in accordance with JHG's Privacy Policy, which is incorporated herein by reference. By using the Service, you accept the Privacy Policy. JHG encourages you to review the Privacy Policy periodically, as it may be updated from time to time.

6. INTELLECTUAL PROPERTY RIGHTS

(a) Your Contributions

You retain any rights you may have in your Contributions; however, by sharing your Contributions you automatically grant JHG a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, unrestricted, and transferable right and license to use, reproduce, publish, distribute, adapt, modify, translate, create derivative works from, publicly perform, and display such Contributions in any form, manner, or medium, without compensation to you.

JHG has the right (but not the obligation) to monitor, review, edit, modify, block, remove, delete, or refuse to publish any Contributions at any time in its sole discretion, without notice or liability. You remain solely and entirely responsible for your Contributions. JHG is under no obligation to store, retain, or make available to you any Contributions you share, and may delete Contributions from its servers at any time without notice.

(b) The Service

All rights, title, and interests in and to the Service (including the Content, Marks, and Features) are owned by or licensed to JHG and are protected by Singapore and international copyright, trademark, patent, and other laws. Users are granted a limited, revocable, non-exclusive license to access and use the Service for informational and personal use only. You are not permitted to copy, download, modify, create derivative works from, reproduce, store, distribute, transmit, display, sell, sublicense, or otherwise exploit any elements of the Service without the prior written consent of JHG.

7. RESTRICTIONS ON YOUR USE OF THE SERVICE

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms. Specifically, you agree:

You shall not use the Service if you are under 18, if your JHG privileges have been suspended or terminated, or if you have not agreed to be bound by these Terms.
You shall not engage in any conduct that could damage, disable, overburden, or impair the Service; violate the security of the Service; circumvent any technological measures implemented by JHG; circumvent JHG's billing process; disrupt another party's use of the Service; modify or remove any copyright or identification markings; infringe intellectual property rights of JHG or other users; or attempt to create similar or substitute services derived from your use of the Service.
You shall not share Contributions that are false, misleading, or infringe intellectual property rights; contain viruses or malicious software; are unlawful, harassing, threatening, defamatory, obscene, discriminatory, or otherwise objectionable; contain proprietary trade secrets; constitute spam, chain letters, or pyramid schemes; or impersonate any person or entity.
You shall not use any automated means such as robots, spiders, crawlers, or scrapers to access, gather, monitor, or copy any Content from the Service or collect personal information from JHG's users.
You shall not attempt to reverse-engineer, decompile, disassemble, decrypt, modify, or create derivative works from the Service, or sublicense, assign, delegate, or otherwise transfer your rights under these Terms without JHG's prior written consent.

8. LINKS TO THIRD-PARTY SERVICES AND CONTENT

JHG may periodically provide information about or hyperlinks to third-party products and services. Such links are provided for convenience only. JHG has not examined or evaluated any content, materials, products, or services available through third-party services and is not responsible for them.

IF YOU DECIDE TO ACCESS ANY THIRD-PARTY SERVICE OR PLATFORM LINKED FROM THE JHG SERVICE, YOU DO SO ENTIRELY AT YOUR OWN RISK. JHG DISCLAIMS ALL WARRANTIES WITH RESPECT TO THIRD-PARTY SERVICES AND PLATFORMS AND DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY CONTENT, MATERIALS, PRODUCTS, OR SERVICES OFFERED BY SUCH THIRD PARTIES. YOU EXPRESSLY RELEASE JHG FROM ANY AND ALL LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF ANY THIRD-PARTY SERVICES, PLATFORMS, CONTENT, OR MATERIALS.

9. LINKS FROM THIRD-PARTY SERVICES

Third parties may publish hyperlinks to the JHG Service provided they: (a) do not replicate or misappropriate any elements of the Service or infringe any intellectual property rights of JHG; (b) do not create a frame or border environment around the Service; (c) do not link to Content only available to registered users; (d) do not imply that JHG endorses them; (e) do not misrepresent their relationship with JHG; (f) do not portray JHG in a false, misleading, derogatory, or negative manner; and (g) do not display content that is offensive, harassing, or objectionable in JHG's sole opinion. This limited license may be revoked by JHG at any time.

10. REPRESENTATIONS AND WARRANTIES

Each time you use the Service, you represent and warrant that: (a) you have the full right, authority, and legal capacity to enter into and perform your obligations under these Terms; (b) your performance under these Terms does not constitute a breach of any other agreement by which you are bound; (c) you possess all necessary rights, licenses, and permissions to use any third-party content in your Contributions; (d) your Contributions will not infringe the intellectual property or other proprietary rights of any third party; (e) your Contributions are accurate, current, and not misleading; (f) you remain fully responsible and liable for all Contributions you share; and (g) your Contributions and use of the Service will comply with all applicable laws and regulations, including those of Singapore.

11. GENERAL RELEASE AND INDEMNITY

By accessing and using the Service, you agree, to the fullest extent permitted under applicable law, to indemnify, defend, release, and hold JHG and its officers, directors, owners, employees, agents, contractors, service providers, consultants, successors, affiliates, and assigns (collectively, the Indemnitees) harmless from and against any and all claims, liabilities, obligations, losses, damages, penalties, demands, actions, suits, costs, and expenses (including attorneys' fees) of whatever nature, arising out of or relating to: (a) your Contributions; (b) your violation of applicable law or breach of these Terms; (c) your violation of any rights of any other person or entity; (d) any dispute between you and other users of the Service; (e) any activity that occurs through your User Account; and (f) any breach or alleged breach of the representations and warranties made by you in these Terms.

12. REMEDIES

You acknowledge that your breach of these Terms may cause JHG immediate and irreparable harm. Accordingly, JHG has the right to immediately seek preliminary and permanent injunctive relief without showing or proving actual damage or posting a bond. JHG's rights and remedies under these Terms are cumulative. In the event of any breach of these Terms by JHG, your sole remedy will be an action at law for damages, and you will not be entitled to seek injunctive or other equitable relief.

13. TERMINATION OF YOUR USER ACCOUNT AND ACCESS TO THE SERVICE

JHG may, in its sole discretion, at any time and without notice, terminate your User Account or restrict, suspend, or terminate your access to the Service if JHG believes your use of the Service: (a) violates these Terms or JHG's other rules, guidelines, and policies; (b) infringes the rights of any person or entity; (c) gives rise to legal liabilities; or (d) is harmful to JHG, its related parties, or users. JHG may also terminate your account for failure to make timely payment of fees, or if your account becomes inactive for an extended period. Upon termination, you agree to immediately pay JHG any unpaid fees owed.

14. DISCLAIMER OF WARRANTIES

JHG MAKES EVERY ATTEMPT TO KEEP THE SERVICE SAFE, SECURE, AND FUNCTIONING PROPERLY; HOWEVER, THE SERVICE IS PROVIDED TO YOU ON AN AS-IS AND AS-AVAILABLE BASIS WITH ALL FAULTS AND WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. JHG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND CONTRACTORS DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES WITH RESPECT TO THE SERVICE TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, TIMELINESS, PERFORMANCE, AND NON-INFRINGEMENT OF THIRD-PARTY PROPRIETARY RIGHTS.

JHG DOES NOT WARRANT THAT OPERATION OF THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS; THAT ANY DEFECTS WILL BE CORRECTED; THAT THE SERVICE WILL BE COMPATIBLE WITH ANY PARTICULAR HARDWARE OR SOFTWARE; OR THAT THE SERVICE WILL MEET YOUR CAREER EXPECTATIONS OR OBJECTIVES.

The Service is controlled and offered by JHG from Singapore. JHG makes no representations that the Service is appropriate or available for use in any other jurisdiction. Users who access the Service from outside Singapore do so at their own risk and are solely responsible for compliance with all applicable local laws and regulations.

15. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL JHG OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND CONTRACTORS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FROM PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL OR REPUTATION, BUSINESS INTERRUPTION, OR ANY OTHER DAMAGES OR LOSSES RESULTING FROM YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE.

In no event will JHG's total liability to you for all damages exceed the aggregate amount of fees actually paid by you for access to and use of the Service in the twelve (12) months preceding the claim. You and JHG agree that any claim or action arising out of or relating to the Service or these Terms must be filed within one (1) year after such claim or cause of action arises, otherwise it will be permanently barred.

16. FORCE MAJEURE

JHG will not be liable for any loss or damage arising out of any delay or failure to perform under these Terms if such delay or failure is caused by events beyond JHG's reasonable control, including but not limited to: fire, flood, earthquake, or other natural disaster; war, riot, or governmental authority; labour dispute; power failure; failure of computer systems or other equipment; internet or communications outages; pandemic, epidemic, or widespread communicable disease; or any other cause that prevents JHG from performing under these Terms.

17. COPYRIGHT POLICY

JHG respects the copyright and proprietary interests of its users. If you believe any Content on the Service infringes your copyrights, you may submit a written notification to JHG that includes: (a) your signature or that of a person authorized to act on your behalf; (b) clear identification of the copyrighted work allegedly infringed; (c) clear identification of the Content that is allegedly infringing; (d) your contact information; (e) a statement that the use of the Content is not authorized by you or permitted under applicable law; and (f) a statement that the information in your notification is accurate.

Notices of claimed infringement should be sent to: copyright@jobhackersglobal.com. All other feedback and inquiries should be directed to: support@jobhackersglobal.com. Upon receipt of a valid notice, JHG will remove or block access to the allegedly infringing Content and give notice of the claimed infringement to the user who shared such Content. JHG recommends that you consult an attorney prior to submitting any copyright notice or counter-notice.

18. TRADEMARK POLICY

If you believe any trademark or service mark owned or controlled by you is being infringed by any other user of the Service, please contact JHG's trademark agent at trademark@jobhackersglobal.com and include: (a) your signature or that of an authorized representative; (b) clear identification of the mark allegedly infringed, including any registration details; (c) clear identification of the allegedly infringing mark and information sufficient to locate it; (d) your contact information; (e) a statement that the use of the mark is not authorized by you or permitted under applicable law; and (f) a statement that the information in your notification is accurate.

19. NOTICES

The email address you provide in your User Account will be used by JHG to send notices pursuant to these Terms, as required by applicable law, and generally regarding your User Account and the Service. You consent to receive all notices and communications by email. Any email JHG sends to you will be considered received within 2 calendar days of the date it is sent to your designated email address.

20. USER COMMENTS AND SUGGESTIONS

JHG encourages its users to help keep the Service safe and functioning properly. Please report any problems, offensive content, or violations of these Terms to: support@jobhackersglobal.com.

JHG may from time to time solicit feedback, comments, ideas, and suggestions about the Service. By providing such Contributions, you grant JHG an irrevocable, perpetual, royalty-free, sublicensable, worldwide license of all intellectual property and other rights comprising such Contributions. JHG is under no obligation to respond to or act upon any feedback you provide. You remain responsible for the content of any such Contributions you provide to JHG.

21. MISCELLANEOUS

These Terms, along with any other legal notices published by JHG on the Service, constitute the entire agreement between you and JHG relating to the subject matter of these Terms and supersede any prior agreements between you and JHG. These Terms will be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of laws principles.

You agree that exclusive jurisdiction over any claim or dispute with JHG arising out of or relating to these Terms or your use of the Service will be decided by the courts of Singapore. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect. No waiver of any provision of these Terms will be deemed a further or continuing waiver of such provision or any other provision.

No agency, partnership, joint venture, employment, or franchise relationship is created by these Terms. You may not assign these Terms or delegate any of your responsibilities to any third party without JHG's prior written consent. JHG may assign these Terms at any time in its sole discretion.

YOU REPRESENT THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND AGREE TO BE BOUND HEREBY.
